James L. McDonald is a member of Cunningham Swan’s Litigation and Labour and Employment Groups.
James regularly provides advice and direction to clients considering a lawsuit or defending actions. An advocate by nature, James has a litigation practice that includes a broad spectrum of municipal, corporate, commercial and contract disputes. He has experience with:
- municipal zoning and by-law litigation;
- municipal election finance prosecutions;
- commercial lease and real property litigation;
- construction disputes and liens;
- representing employers with unjust and wrongful dismissal claims;
- applications under the Human Rights Code;
- defamation litigation; and
- personal injury, LTD, accident benefits and other insurance claims.
James appears regularly before the Ontario Superior Court of Justice and has experience at the Ontario Court of Appeal and administrative tribunals. He has also participated in mediations, arbitrations and other forms of alternative dispute resolution.
James is a member of the Frontenac Law Association and Law Society of Upper Canada. An avid sportsman and hiker, James participates annually in the Ottawa marathon and has completed the International Four Day Marches in Nijmegen, Netherlands. He is an active member of Kingston’s local Naval Reserve Division, HMCS Cataraqui, a Director of the Rotary Club of Cataraqui-Kingston, and a Trustee of the Marine Museum of the Great Lakes at Kingston. His contributions to our community and to Canada were recognized in 2012 with the Queen Elizabeth II Diamond Jubilee Medal.
